Heard ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website and services. Please read this policy carefully. If you do not agree with the terms of this Privacy Policy, please do not use our services.

This policy is provided in compliance with the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and the Telephone Consumer Protection Act (TCPA).

1. Information We Collect

We collect the following categories of personal information:

Email address — collected to verify you are a real person, track your weekly vote eligibility, and, if you consent, to send you notifications from artists you have requested.
City / location — the city you provide when voting, used to show you relevant artist demand data.
Voting data — the artists you vote for and when you voted.
Notification preferences — which artists you have requested notifications for.
Email consent record — whether you opted in to email notifications, the date and time of consent, and your IP address at the time of consent. This is retained for legal compliance.
IP address — collected at the time of SMS consent for legal record-keeping only.

We do not collect your name, email address, payment information, or precise GPS location.

2. How We Use Your Information

To enforce the one-vote-per-week limit.
To display aggregated, anonymous artist demand leaderboards.
To send you email notifications on behalf of artists you requested, if you have provided explicit consent and the artist elects to notify fans.
To maintain legally required records of SMS consent.
To improve and operate the Heard platform.

3. Email Notifications

If you opt in to email notifications, you agree to receive emails from Heard when an artist you have requested elects to notify fans about an upcoming show near your city. Heard does not monitor tour schedules or send automatic notifications — emails are sent only when an artist or their representative chooses to reach out to fans through the Heard platform. Message frequency varies.

To opt out: Click the unsubscribe link in any email at any time. You may also turn off notifications for individual artists on the Heard website.

Consent to receive emails is not a condition of using Heard or casting a vote.

4. Sharing Your Information

We do not sell, rent, or trade your personal information to third parties. We may share information with:

Resend — our email delivery provider, solely to transmit emails you have consented to receive. Resend's privacy policy is available at resend.com/legal/privacy-policy.
Supabase Inc. — our database provider, which stores your data securely on servers in the United States.
Law enforcement or regulators — if required by law, court order, or to protect the rights and safety of Heard or its users.

5. Your California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following rights:

Right to Know — you may request a copy of the personal information we have collected about you.
Right to Delete — you may request that we delete your personal information, subject to certain exceptions.
Right to Correct — you may request that we correct inaccurate personal information we hold about you.
Right to Opt Out of Sale — we do not sell your personal information.
Right to Non-Discrimination — we will not discriminate against you for exercising any of your privacy rights.

To exercise these rights, contact us using the information in Section 8, or use our self-service data deletion form to immediately delete your account and all associated data. We will respond to written requests within 45 days.

6. Data Retention

We retain your phone number and voting history for as long as your account is active or as needed to provide our services. SMS consent records are retained for a minimum of 4 years as required by TCPA regulations. You may request deletion of your data at any time by contacting us.

7. Security

We implement industry-standard technical and organizational measures to protect your personal information. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
